Official Rules
NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
ELIGIBILITY: The Pappy & Company Bourbon for Good Sweepstakes (“Sweepstakes”) begins on January 23, 2024 at 12:01 a.m. Eastern Time (ET) and ends on January 30, 2024 at 11:59 p.m. (“Sweepstakes Period”). The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older at time of entry. Void where participation or delivery of prize is prohibited. Employees of Van Winkle Goods LLC, d/b/a Pappy & Company (“Sponsor”), and its parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Sweepstakes (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or same household) of Sponsor or any Sponsor Affiliates are not eligible to participate.
TO ENTER: During the Sweepstakes Period, you may enter the Sweepstakes in one or both of the following ways to receive up to a maximum total 10 entries per person/email/mail address (the “Entry Limit”):
Any questions shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by person who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Sweepstakes. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account associated with the, as applicable, purchase and online entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email addresses for the domain associated with the submitted email address.
PRIVACY: By participating in the Sweepstakes, participant agrees to all of the terms and conditions of Sponsor’s Privacy Policy, available at https://pappyco.com/pages/privacy. All information submitted by you will be treated according to Sponsor’s Privacy Policy. By participating in the Sweepstakes and providing any applicable contact information, you hereby agree to Sponsor’s collection and usage of your personal information. In the event of any discrepancy between Sponsor’s Privacy Policy and these Official Rules, these Official Rules will control.
PRIZE WINNER SELECTION AND NOTIFICATION: After the close of the Sweepstakes Period, on or about January 30, 2024, Sponsor will randomly select one (1) potential winner out of all eligible entries received. Sponsor will notify the potential prize winner(s), using the email address, phone number or other contact information provided in the entry, on or about January 30, 2024. Potential winner(s) must respond to the notification email and provide all requested information, within [48 hours] of the notification being sent or the potential prize will be forfeited. To claim any prize, Sponsor may require winner(s) to complete, sign, and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, which may require a social security number, postmarked within [five (5)] days of the time on the notification. If a potential winner cannot be contacted, fails to timely claim the prize, is disqualified, fails to timely execute and return any required forms, or if the prize notification is returned as undeliverable, an alternate winner will be selected by random draw from all remaining eligible entries.
PRIZE(S): This Sweepstakes has ONE (1) GRAND PRIZE: One (1) bottle of Van Winkle's Special Reserve 12-Year Old Bourbon personally signed by Julian Van Winkle. MSRP $79.99
Prizes are awarded “AS IS.” Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Sweepstakes or any prize. No manufacturer of any offered prize is associated with or sponsoring the Sweepstakes. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion (including as provided below). Federal, state, or local taxes on prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of each winner.
SHIPPING RESTRICTIONS: State and federal laws apply to the shipment of alcohol. Upon selection of the winner, Sponsor will identify the relevant options to delivering the Grand Prize based on the delivery address provided by the winner. Sponsor will discuss any relevant restrictions delivery with the winner and identify available options that comply with applicable laws. In the event Sponsor is unable to deliver the Grand Prize due to legal restrictions, Sponsor may substitute the Grand Prize with a non-alcoholic prize of equivalent value.
PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes entrant’s consent for Sponsor and its designees to use entrant’s name, likeness, prize information, city and state of residence for promotional purposes in any media without further consideration.
RELEASE AND LIMITATION OF LIABILITY: Except where prohibited, by participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, Sponsor Affiliates and each of their respective parents, subsidiaries, affiliates, promotional partners, prize partners, agents and agencies, and the officers, directors and employees of them (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Sweepstakes entry, if it is possible.
OTHER TERMS: Decisions of Sponsor on all matters related to the Sweepstakes are final. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. Under no circumstances will more than the advertised number of prizes be awarded. Sponsor reserves the right to cancel or modify the Sweepstakes for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Sweepstakes as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW.
GOVERNING LAW & MANDATORY ARBITRATION: Any disputes arising under this Sweepstakes and/or these Official Rules will be governed by relevant U.S. federal statutes and regulations and the internal laws of the Commonwealth of Kentucky. Sponsor and each entrant agree that any claim or dispute the parties are unable to resolve informally that is related to this Sweepstakes and/or these Official Rules (including the applicability of this arbitration clause) shall be resolved by binding arbitration administered by the JAMS under its rules and procedures in effect when the claim is filed. The rules and procedures and other information, including information on fees, may be obtained from JAMS’ website (www.jamsadr.com) or by calling JAMS at 949-224-1810. Further, in any such dispute, claim or cause of action, under no circumstances will either party be permitted to obtain awards for, and hereby waives all rights to claim indirect, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant's actual out-of-pocket expenses (i.e., costs associated with entering the Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
NO AFFILIATION: This Sweepstakes is in no way sponsored, endorsed, administered by or associated with any social networking platform from which you may learn of or that may be in some manner connected to this Sweepstakes (collectively, “Social Networks”). By participating, you release the Social Networks and their respective parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, from and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize.

WINNER LIST: For the winner’s list or a paper copy of these Official Rules, send your request and a stamped, self-addressed envelope to Pappy & Company, Cigar Sweepstakes, Attn: Brittany Clark, 843 East Market Street, Louisville, KY 40206. Requests must be received within thirty (30) days after the Sweepstakes Period has ended. Vermont residents may omit return postage.
