2023 Pappy & Company Golden Ticket Official Rules
NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
ELIGIBILITY: The Pappy & Company Golden Ticket event (“Golden Ticket”) begins on Tuesday, October 10, 2023 at 12:01 a.m. Eastern Time (ET) and ends on Saturday, October 14, 2023 at 11:59 p.m. Eastern Time (ET) (“Golden Ticket Period”). The Golden Ticket event is open to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older at time of enter. Void where participation or delivery of prize is prohibited. Employees of Van Winkle Goods LLC, d/b/a Pappy & Company (“Sponsor”), and its parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Golden Ticket event (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or same household) of Sponsor or any Sponsor Affiliates are not eligible to participate.
TO ENTER: During the Golden Ticket Period, you may enter the Golden Ticket in one or both of the following ways to receive up to a maximum total ten (10) entries per person/email address (the “Entry Limit”):
LIMIT:There is a limit of ten (10) total entries per person/email regardless of the method of entry chosen. Excess entries (whether by Purchase Entry of Email Entry) will be discarded.
No mechanically reproduced or photocopied entries will be accepted. Sponsor is not responsible for lost, late, misdirected, damaged, illegible, incomplete, incorrect, postage due entries/mail or any other entry not received regardless of cause. Entries become the property of Sponsor and will not be returned. Any questions shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by person who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Golden Ticket event. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account associated with the, as applicable, Purchase Entry and Email Entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email addresses for the domain associated with the submitted email address.
PRIVACY:By participating in the Golden Ticket event, participant agrees to all of the terms and conditions of Sponsor’s Privacy Policy, available athttps://pappyco.com/pages/privacy. All information submitted by you will be treated according to Sponsor’s Privacy Policy. By participating in the Golden Ticket event and providing any applicable contact information, you hereby agree to Sponsor’s collection and usage of your personal information. In the event of any discrepancy between Sponsor’s Privacy Policy and these Official Rules, these Official Rules will control.
PRIZE WINNER SELECTION AND NOTIFICATION: After the close of the Golden Ticket Period, on or about Saturday, October 14, 2023, Sponsor will randomly select eleven (3) potential winners out of all eligible entries received. In no event will more that the stated number of prize winners receive a prize.
PRIZE(S): This Golden Ticket event has One (1) Grand Prize, One (1) Second Prize winner, and One (1) Third Prize Winner as follows: (a) the Grand Prize winner will receive a $250 Van Winkle Goods LLC gift card (“Gift Card”); (b) the Second Prize winner will receive a $100 Gift Card; and (c) the Third Prize winner will receive a $50 Gift Card. Gift Cards may only be redeemed for purchases on the Website by entering the code included with each Gift Card prior to completion of the purchase transaction.
For purchase method of entry, the Gift Card will be included in the package of the product purchased. Winners via Email Entry will be sent the Gift Card via email or to the winner’s mail address. Prizes are awarded “AS IS.” Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability, and fitness for a particular purpose) in connection with this Golden Ticket event or any prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion (including as provided below). Federal, state, or local taxes on prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of each winner.
PUBLICITY:Except where prohibited, participation in the Golden Ticket event constitutes entrant’s consent for Sponsor and its designees to use entrant’s name, likeness, prize information, city, and state of residence for promotional purposes in any media without further consideration.
RELEASE AND LIMITATION OF LIABILITY: Except where prohibited, by participating in the Golden Ticket event, entrants agree to release and hold harmless Sponsor, Sponsor Affiliates and each of their respective parents, subsidiaries, affiliates, promotional partners, prize partners, agents and agencies, and the officers, directors and employees of them (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Golden Ticket event or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Golden Ticket event; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Golden Ticket event or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Golden Ticket event or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Golden Ticket event and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Golden Ticket event entry, if it is possible.
OTHER TERMS: Decisions of Sponsor on all matters related to the Golden Ticket event are final. If the Golden Ticket event, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. Under no circumstances will more than the advertised number of prizes be awarded. Sponsor reserves the right to cancel or modify the Golden Ticket event for any reason, including but not Golden Ticket event limited to, if fraud, misconduct, or technical failures destroy the integrity of the , or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Golden Ticket event as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS GOLDEN TICKET EVENT IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW.
GOVERNING LAW & MANDATORY ARBITRATION: Any disputes arising under this Golden ticket event and/or these Official Rules will be governed by relevant U.S. federal statutes and regulations and the internal laws of the Commonwealth of Kentucky. Sponsor and each entrant agree that any claim or dispute the parties are unable to resolve informally that is related to this Golden Ticket event and/or these Official Rules (including the applicability of this arbitration clause) shall be resolved by binding arbitration administered by the JAMS under its rules and procedures in effect when the claim is filed. The rules and procedures and other information, including information on fees, may be obtained from JAMS’ website (www.jamsadr.com) or by calling JAMS at 949-224-1810. Further, in any such dispute, claim or cause of action, under no circumstances will either party be permitted to obtain awards for, and hereby waives all rights to claim indirect, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant's actual out-of-pocket expenses (i.e., costs associated with entering the Golden Ticket event), and Entrant further waives all rights to have damages multiplied or increased.
NO AFFILIATION:This Golden Ticket event is in no way sponsored, endorsed, administered by, or associated with any social networking platform from which you may learn of or that may be in some manner connected to this Golden Ticket event (collectively, “Social Networks”). By participating, you release the Social Networks and their respective parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, from and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Golden Ticket event and/or the acceptance, awarding, receipt, use and/or misuse of the prize.

WINNER LIST: For the winner’s list or a paper copy of these Official Rules, send your request and a stamped, self-addressed envelope to Pappy & Company, Golden Ticket event, Attn: Brittany Clark, 843 East Market Street, Louisville, KY 40206. Requests must be received within thirty (30) days after the Golden Ticket Period has ended. Vermont residents may omit return postage.
